The bail application of Livhuwani "SABC Livhu" Madadzhe was postponed yet again this week.
His court appearance on Monday (27th) started late as the court could not work because of load shedding. The bail application was presented in the form of a written affidavit.
The state called its witness, Sergeant Rembuluwani Nekhavhambe, who is the investigating officer in the case. He said that Madadzhe should not be granted bail, considering the strong case they had against him. Nekhavhambe testified that Madadzhe was the last person to be with the deceased, Lindelani Nengovhela.
The application continued the next day (28th), with the state, represented by Mr Tovhowani Tshisaphungo, and the defence, represented by Advocate Ntsako Hlungwani, having made their closing arguments.
The court postponed the case to 6 April for the presiding magistrate, Mr Mukoma Maiwashe, to apply his mind for judgement.
Advocate TP Matodzi, the watching brief for the bereaved family, said he was happy that the state had successfully managed to present its case and that he was hopeful that Madadzhe would not be granted bail.
The deceased's aunt, Ms Elsie Nengovhela, said however that the family was angered by Advocate Hlungwani's behaviour. "He swore at us, using the worst vulgar words. We are not happy at all," she said. Regarding Madadzhe, she said he should "rot in jail" and not be granted bail.
The murder charge against the comedian stems from an incident on 28 January this year, when the body of his late wife, Lindelani Nengovhela, was found in a water-filled trench at the couple's home at Mangondi Sidou outside Thohoyandou. Madadzhe has been in custody since then.
